PRIVACY NOTICE

This notice informs you of what data we keep on you as a client, what we are going to do with it, and your rights under the new General Data Protection Regulations.

WHY DO WE NEED TO COLLECT AND USE YOUR PERSONAL DATA?

Lacomp plc will be the ‘Controller’ of the personal data you provide to us.

The primary legal basis that we intend to use for the processing of your data is for the performance of our contract with you. The information that we collect about you is essential for us to be able to carry out effectively the services that you require from us. Without collecting your personal data, we would also be unable to comply with our legal and regulatory obligations.

Where special category data is required, we will obtain your explicit consent in order to collect and process this information.

PERSONAL DATA THAT WE KEEP ON YOU:

  • Name, address and other contact details;

  • Personal circumstances (health, family, income, expenditure, assets, liabilities);

  • Financial arrangements (investments, policies, pensions, properties, etc);

  • ‘Soft data’ (attitude to risk, personal financial objectives etc).

WHY WE KEEP THE DATA AND WHAT WE ARE GOING TO DO WITH IT:

  • To assist us in keeping in contact with you;

  • To ensure that our advice is accurate, relevant, and suitable;

  • To help us maintain a robust ongoing review service;

  • So that we may represent your interests to third-party companies (e.g. product-providers);

  • To assist your family and dependants (when authorised to do so).

HOW LONG DO WE KEEP HOLD OF YOUR INFORMATION?

Your personal data should not be held for longer than is required under the terms of our contract for services with you, however we are subject to a regulatory requirement to retain data for specified minimum periods and we reserve the right to retain data for longer than this due to the possibility that it may be required to defend a future claim against us. In any case, we will not retain your personal data for longer than 15 years past the time of your death.

You may at any time withdraw your consent for us to process any sensitive data (health, religion, sexual orientation and so on) however that withdrawal does not have any impact upon the lawful processing that has occurred up to that point.

You have the right to request deletion of your personal data. We will comply with this request, subject to the restrictions of our regulatory obligations and legitimate interests as noted above.

WITH WHOM MIGHT WE SHARE YOUR INFORMATION?

In order to deliver our services to you effectively we may send your details to third parties, such as those that we engage for professional compliance, accountancy, or legal services, as well as product and platform providers that we use to arrange financial products for you.

Where third parties are involved in processing your data, we will have a contract in place with them to ensure that the nature and purpose of the processing is clear, that they are subject to a duty of confidence in processing your data and that they will only act in accordance with our written instructions.

Where it is necessary for your personal data to be forwarded to a third party, we will use appropriate security measures to protect your personal data in transit.

To fulfil our obligations in respect of prevention of money-laundering and other financial crime, we may send your details to third party agencies for identity verification purposes.

UNDER THE GDPR YOU HAVE THE RIGHT TO REQUIRE US TO:

  • tell you what data we keep on you;

  • access such data;

  • rectify any mistakes there are in the data;

  • erase all information we have on you (where we have provided regulated advice we would instead archive your information);

  • stop processing your data (and therefore provide no further advice);

  • move the data we hold to someone else, and

  • remedy something we have done contrary to the Regulations.
